Why was Munawar Faruqui arrested?
The news about Munawar Faruqui hit all the headlines in very early January. The 30-year-old Faruqui and four other people were arrested on January 1 just before he was about to start his performance at a cafe in the popular 56 Dukan locality of Indore, one more person was arrested later, for allegedly making objectionable remarks about Hindu deities and Union Home Minister Amit Shah during a show in Indore on New Year’s Day, as cited by Los Angeles Times.

Soon after the show, Eklavya Singh Gaud, son of BJP MLA Malini Laxman Singh Gaud, had filed a complaint against Faruqui and others.
Gaud had said that he and his associates went to watch the show and they witnessed Faruqui allegedly make indecent jokes about Hindu deities. Gaud further said that he forced the organizers to stop the show soon after that.
Reports also emerged that Faruqui and his associates were beaten by members of the audience. According to Outlook India, Faruqui was then arrested under various sections of the Indian Penal Code, including section 295-A which deals with deliberate and malicious acts, intended to outrage religious feelings of any class.
Denied bail three times by a state court, Faruqui appealed to the country’s Supreme Court, which ordered Friday that he be released from jail pending a trial. Critics say he has become a prominent example of an escalating crackdown against free speech in Prime Minister Narendra Modi’s India.
A growing number of entertainers, activists, lawyers, and academics who have spoken against Modi’s Hindu nationalist government have been arrested, charged with sedition and other serious crimes, or viciously attacked on social media.
In recent days, India has filed criminal charges against journalists who covered a Jan. 26 protest by farmers against proposed agricultural laws. It ordered Twitter to block hundreds of accounts critical of the prime minister and threatened the company’s employees with jail time if they didn’t comply. Last month, the producers of a fictional Amazon Prime Video series called “Tandav” apologized after politicians from Modi’s party claimed the show had insulted Hindus.
Latest update: Munawar Faruqui was granted interim bail by the Supreme Court on FridayThe Supreme Court on Friday took less than a minute to order interim bail for Munawar Faruqui, as cited by Hindustan Times. “The petitioner (Faruqui) is released on ad-interim bail on conditions to the satisfaction of the trial court,” said a bench of justices Rohinton F Nariman and BR Gavai. The bench seemed to be in agreement with Faruqui’s advocate Saurabh Kirpal, who argued that Indore police did not follow the procedure laid out by the SC in its 2014 order in the Arnesh Kumar case on the process of the police probe. Staying the Madhya Pradesh high court judgment that declined bail to Faruqui, the apex court issued notices to the state police as well as to the complainant in the case, Hindu Rakshak Sangathan convener Eklavya Singh Gaud, son of a Bharatiya Janata Party (BJP) legislator Malini Singh Gaud. The bench also restrained the Uttar Pradesh police from arresting Faruqui in a separate case registered against him at Prayagraj for allegedly offending religious feelings through his jokes. |
