An Overview of State Holidays in California

The state of California follows the federal holiday schedule.

In 2023, the Golden State will observe three new holidays: Juneteenth, Genocide Remembrance Day, and the Lunar New Year. Is it mandatory that we provide employees with paid vacation time?

In 2022, Governor Gavin Newsom gave his stamp of approval to multiple new state holidays that had been proposed by the California legislature. A "statewide holiday" called Genocide Awareness Day was declared on April 24 by the California Assembly and Senate, for instance.

Although these new holidays have been designated in California, their designation is mostly symbolic. State employees do not receive payment for these days off.

There are two major pieces of information to keep in mind about California state holidays:

All public offices and employees in California are required by law to observe certain state holidays.

No California private company is obligated to close or otherwise treat its employees differently on any of the state-designated holidays.

Similar procedures apply to federal holidays. Offices and employees of the government are subject to these.

Private companies that are not part of the government are not obligated to give their workers paid time off. Businesses are free to choose whether they will be open or closed on holidays, whether they will pay their employees when they are open or closed, and whether they will pay special premium wages when they are open.

In reality, a lot of companies provide paid vacation time to their workers. This is accomplished by paying workers their full salary as holiday pay and closing on certain holidays like Christmas and Thanksgiving. In addition, businesses have the option to keep their doors open on specific holidays in exchange for premium wages—1.5 or even 2 times the regular rate—for their employees. The employer is free to make these decisions as they see fit.

Nonetheless, businesses have a responsibility to make reasonable accommodations for their workers' religious practices, such as providing time off for holidays or other religious observances. Employers are not obligated to grant religious leave if they can demonstrate that doing so would cause an unreasonable burden on the business.

Like paid vacations, holiday pay and time off have long been a competitive recruiting tool for companies looking to fill positions with people who place a high value on their own personal time. A company's policy regarding holidays can be tailored to its own needs and culture, or it can opt to totally disregard the California list of holidays.

1. Mar 31, Cesar Chavez Day, Government Holiday, State holiday in California

Cesar Chavez Day is celebrated annually on his birthday, March 31st. In 2014, President Barack Obama proclaimed Cesar Chavez Day as a national holiday.

While it is not recognized as a federal holiday, it is observed as a state holiday in California. The California State Legislature established Rosa Parks Day, which was first observed on February 4, 2000. California decided to honor the anniversary of Rosa Park's birth. Ohio and Oregon commemorate the day of her arrest, December 1.

The Juneteenth National Independence Day Act, which was signed into law by President Biden in 2021, established Juneteenth as a holiday in California and the entire United States.
